1. GENERAL REMARKS.
PROMOTUR TURISMO CANARIAS S.A., hereinafter PROMOTUR, with its registered address in calle Víctor Hugo, 60, 35006 Las Palmas de Gran Canaria, with C.I.F. A-35845593, registered in the Mercantile Registry Office of Las Palmas, on folio 141, volume 1758, page GC-35913, is the owner of the http://www.turismodecanarias.com website (hereinafter the website).
All use made of the website previously mentioned implies the full acceptance by the user of all the conditions contained in the present Legal Information. Consequently if the user does not agree with the content of this information they should refrain from using this website.
2. INTELLECTUAL OR INDUSTRIAL COPYRIGHT.
PROMOTUR, in its own right or through agreements with third parties, is the owner of all the intellectual and industrial copyrights of the website as well as all the elements contained in same (titles and headings, images, sound, audio, video, software or texts; brands or logos, combinations of colours, structure and design, choice of materials used, computer programs necessary for their functioning, access and use etc).
Consequently the aforementioned website and the elements contained therein are protected by the rights of intellectual and industrial copyright established by the relevant legislation. The use of this material, or any type of reproduction, distribution, modification or public communication of the same, whether it is total or partial, involving the data, elements and contents which can be accessed through the website, beyond that expressly permitted in this Legal Information, is hereby expressly forbidden and will be prosecuted.
Within the agreement made by the user in terms of all the intellectual and industrial copyright of this website, said user is allowed to visualize the elements and even print them, and store them in the hard disc of their computer or in any other medium, as long as this is only and exclusively for their personal and private use. In this sense it is completely prohibited for the user to transform the material, or distribute it, communicate it publicly, place it at the disposal of others, or effect any other kind of exploitation of the material, including its modification, alteration or re-organization. The user must refrain from suppressing, altering, avoiding or manipulating any means of protection or security system which may be installed in the website.

3.1.1. Information contained in website: General remarks.
All information provided by PROMOTUR through its website aims to be objective and is based on official information sources and public knowledge, as well as being the product of publicity and marketing creative work whose aim is to promote tourism in the Canary Islands. PROMOTUR is not responsible for any error, inaccuracy or lack of truth in any of the information sources used for this end.
PROMOTUR reserves the right to make any modifications in the information contained in the website at any time, as well as the right to suspend access at any time and without previous warning. Both access to the website and the use which may be made of the information contained in same by users are the full and exclusive responsibility of the user.
3.1.2. Links to independent websites.
The website contain linkss to other websites not related to PROMOTUR for the convenience of their users. As soon as a user has access to a website unrelated to PROMOTUR, they will be bound by the information, advice and legal warnings established by this other website for its use.
By the same token, the links which PROMOTUR makes available to the user are there solely to facilitate access to other content and/or services which may be of interest to them; however, these are not controlled or managed by PROMOTUR. The inclusion of these contents and/or services does not imply any kind of association, fusion or participation by PROMOTUR with the relevant bodies.
3.1.3. Services, Products and Information of third parties.
PROMOTUR offers the services referred to in the present conditions freely, without prejudice to what may be established in terms of price by any other specific services or products offered, which will be referred to in due course in the relevant sections.
PROMOTUR does not control, or approve, or take responsibility in advance for the contents, services, products or any other type of information of third parties, legal or physical bodies included in the website. Any contractual or extra-contractual relation which may be formalized by advertisers or third parties contacted through the website, as well as participation in competitions, promotions, and the buying and selling of goods or services are understood to be undertaken uniquely and exclusively between the user and the advertiser and/or the third party.
Consequently, PROMOTUR does not accept any type of responsibility, whether direct or indirect, in relation to the validity, legality, usefulness, quality or trustworthiness of the contents and/or services which are not directly managed or controlled by PROMOTUR, even if they have been accessed through the website. The user accepts that PROMOTUR is in no way responsible for any damages of any kind caused by their negotiations, conversations and/or contractual or extra-contractual relations with advertisers or with physical or legal third parties contacted through the website.
3.2. Technical Conditions.
Based on the general principles of the processes of electronic communication, PROMOTUR does not guarantee that access to the website will not be interrupted, delayed, contain errors or omissions, or contain viruses or other elements of a similar nature.
PROMOTUR is not responsible for any damages of any kind which may be suffered by the user or by a third party caused by:
- The lack of availability, maintenance or effective functioning of the website or of its services and content.
- The infringement by a third party of the security measures established by PROMOTUR, of the website, their content or services in order to eradicate the virus, or to carry out an unauthorized treatment of the data stored by PROMOTUR.
- In general, of any use of the website, their services and/or contents which may be carried out by the user or a third party and which goes against the conditions of access and use established by PROMOTUR.
4. PROTECTION OF DATA AND PRIVACY POLICY.
PROMOTUR informs the public that, through its website, it will collect data of a personal nature when this is specified in the forms designed for this purpose. In these cases the forms will also establish, expressly and legibly, the conditions under which personal data are collected and the aims for which they are used, as well as information relating to the obligation to provide such data or not, the rights belonging to the user, the conditions in which these may be applied and any other extra information which is deemed necessary. Any information concerning identified or identifiable physical people is understood to refer to data of a personal nature, in accordance with the relevant legislation.
Personal data provided through the forms which are identified in this way will be used by PROMOTUR to carry out publicity and promotional activities relevant to the tourist sector adapted at all times to the particular aim of the form in which the data has been collected.
At all times the following actions are understood to be included in the concept of publicity and promotional actions of the tourist sector:
- The right to send publicity, promotional and commercial information and material for products and services of PROMOTUR or of third party tourist companies through the means which have been authorized by the users which include the following: the receipt of free gifts or greetings, magazines, postcards or similar actions.
- The use of personal data for statistical or historical purposes, and to carry out opinion surveys or similar actions.
PROMOTUR wishes to make website users, and especially registered users, aware of their policy regarding the treatment and protection of data of a personal nature with the aim of the visualization of the website or of the use of the products and services offered in same.
By treatment of personal data we refer to those operations and technical procedures, whether automatic or not, which enable the collection, recording, preservation, elaboration, modification, blocking or cancellation, as well as the destruction of data which may come from communication, consultation, interconnections and transferences.
The collection of personal information, its treatment and its subsequent use is subject to the current legislation in Spain that deals with data protection, established by the Organic Law 15/1999, of 13 December, for the Protection of Data of a Personal Nature (hereinafter LOPD) and its complimentary regulations. PROMOTUR will be responsible and will guarantee the confidentiality and security with respect to data of a personal nature which is collected from the user through the website, and is committed to fulfil its obligations of secrecy with respect to data of a personal nature and to its duty to deal with these with all due confidentiality. For these purposes it will adopt the necessary measures to avoid their alteration, loss, treatment or un-authorized access. The levels of security adopted by PROMOTUR will be in accordance with the data which has been provided, corresponding to the aims set out in article 9 of the above-mentioned Law and Title VII of the Royal Decree 1720/2007, of 21 December, which ratifies the Regulation for the Development of the Law 15/1999, of 13 December for the Protection of Data of a Personal Nature.
In certain cases it is acceptable to give personal data to third parties. When this is the case, this circumstance will be duly notified to users, and the body to which they are given and the destination will be specified, as well as the activities to which they are dedicated and the ultimate aim for which they are handed over.
Users may exercise their right of access, correction, cancellation and disagreement, as well as the right to be informed and to disagree with the material being given to third parties by contacting PROMOTUR through a written communication, providing a photocopy of the National Identity Document or other legally valid medium which accredits the identity of the user, and which must be sent to the following address:

The communication must include the following information:
Name and surname of user
Statement in which the nature of the user’s concern is made clear
Address to be used for further contact; date and signature of the user
Any documents which validate the request made, where relevant.
PROMOTUR informs all users that the exercise of these rights is of a personal nature, and consequently the user him- or herself may exercise these rights with respect to the personal data of which he or she is the legitimate owner. However, and in certain cases which may exceptionally be accepted, a duly authorized representative for the user may exercise the rights which correspond to the user in the terms set out above, as long as the statement specified above is accompanied by an accredited document which gives permission for this representation.
Notwithstanding the information given in the previous paragraphs, the opposition or withdrawal of the permission given by the user to be sent publicity or promotional communications by e-mail or any other equivalent form of electronic communication will be placed at the disposal of the user through simple and free means, and the user will be suitably informed of this at the same time that they provide their e-mail address for this purpose. However, the user may revoke the permission given for the reception of commercial communications at any time via the postal address or the e-mail address indicated above or at the address all link provided for this purpose in the communication itself which they receive.
In the zone 2.0 users can contribute, and consequently share with other users, any information and data about the Canary Islands which they consider appropriate, as long as they limit themselves to content which is appropriate for all types of reader, including children; and that they do not contravene any of the protected rights which are mentioned in this Legal Information document; similarly, the content of their contribution must be directly related to tourism in the Canary Islands; and it must not be limited to a narrow period of time but rather should be applicable to a longer period of time. Requests related to any aspects of the website will not be accepted through this medium.
PROMOTUR in the Zone 2.0 is not responsible for any data, information or opinion expressed therein. However, users of this zone expressly accept that PROMOTUR may access the content which appears in the form mentioned above and/or in the website which has been accessed via the external URL. Any user or third party who believes that their rights may have been infringed by irregular use of the information contained in the Zone 2.0 can get in touch with PROMOTUR in order that, once the request has been examined, appropriate measures may be taken when necessary to avoid this breach, by writing to the e-mail address given in Point 2 of the present Legal Information.
PROMOTUR does not guarantee publication in the Zone 2.0 of any content proposed and sent through the form available for this purpose at www.turismodecanarias.com.
PROMOTUR guarantees the adoption of the security measures established by article 9 of the Organic Law 15/1999, for the Protection of Data of a Personal Nature and of the regulations which develop this law.
Such measures will be appropriate to guarantee the security of data of a personal nature and avoid their alteration, loss, treatment or un-authorized access, taking into account the state of technology, the nature of the data stored and the risks to which they are exposed, whether these may come from human actions or from physical or natural means.
PROMOTUR will not register data of a personal nature in files which do not fulfil the conditions which have been determined by law with respect to their safety and security, or in treatment centres, work areas, computers, systems and programs.
If any independent companies should have access to the personal data of the users with the aim of being of service to PROMOTUR, the latter guarantees users that, in the contracts of provision of services agreed with such companies, the security measures which these third parties will be obliged to adopt with reference to the nature of the data to which they have access must be stipulated, and must conform to the rules established by the LOPD and its relevant regulations.
The access passwords that PROMOTUR may make available to the user of the website for their access and/or use for a specific service or existing content in the website are confidential, secret, personal and not transferable, for the access and/or enjoyment of the relevant service or content.
The service or content whose access or enjoyment needs previous validation by the user through the access passwords may be blocked by PROMOTUR if there were to be a certain number of successive errors in the use of the password. This block will only be lifted once PROMOTUR has satisfactorily checked the identity of the user. Once the block has been lifted new passwords will be set up and handed over.
The user is responsible for the privacy of their access passwords and these should never be given to third parties, nor should their discovery be made possible through their recording on any kind of medium. If it should happen that the access passwords are accidentally or fraudulently discovered by unauthorized third parties, or if any other event occurs which compromises their confidential nature, this should be immediately communicated to PROMOTUR.
The users of the website renounce expressly any other rights which may correspond to them, notwithstanding the competence implied by the application of the law and they are liable to the Courts and Tribunals of the city of Las Palmas de Gran Canaria for the resolution of any questions which may arise over the interpretation, application and fulfillment of these conditions, as well as any claims which may derive from their use.
